QUESTION: Councillor F. Timmons
To ask the Chief Executive if there is any way of stopping shops putting for sale items out in front of there shop?
REPLY:
It is an offence under Section 71 of the Road Act, 1993, to place items for sale on the public footpath. The council may remove, store and eventually dispose any offending article at the expense of the relevant trader. Planning permission may be required for the use of private lands in front of a shop for the sale of goods, given there are only certain exemptions for occasional trading, e.g. markets, car-boot sales etc.
